MemPalace Cloud is operated by JC Software GmbH, Oskar-Winter-Straße 9, 30161 Hannover, Germany (the "Operator", "we", "us"). Full operator details are in our Imprint. References to "MemPalace Cloud" in these Terms mean the service provided by JC Software GmbH.
MemPalace Cloud provides a hosted version of the open-source MemPalace memory engine, integrated with common AI coding tools via the Model Context Protocol (MCP). We are not officially affiliated with the upstream MemPalace project unless explicitly endorsed by its authors.
You must provide accurate information when creating an account. You are responsible for keeping your credentials secure and for all activity on your account. You must be at least 16 years old to use the service.
You agree NOT to:
Paid subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time via your account settings. Payments are processed by our payment provider Polar (Polar Software Inc.), who acts as merchant of record. Cancellation, refunds, and EU consumer withdrawal rights are governed by our Refund Policy.
Your stored memories are never hard-deleted while your account is active. Retention restrictions on paid plans affect searchability, not existence — you can always upgrade to restore full search coverage. If you delete your account via Settings, all personal data (memories, inbox items, settings) is permanently deleted immediately. If you request deletion via email, we process it within 30 days. Billing records (invoices, payment history) are retained for 10 years as required by German tax law (AO § 147, HGB § 257). You can export your data in JSON format at any time via Account Settings.
We do not currently offer an uptime SLA. We make reasonable efforts to notify users of planned maintenance at least 24 hours in advance.
To the maximum extent permitted by law, MemPalace Cloud is provided "as is" without warranties. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. This does not limit our liability for willful misconduct, gross negligence, or personal injury under mandatory EU consumer protection law.
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes will be resolved in the competent courts of Germany. EU consumers retain the right to file claims in their home jurisdiction under mandatory consumer protection law.
We will notify you by email at least 30 days before any material change. Continued use after the effective date constitutes acceptance. If you disagree, you may cancel your account before the change takes effect.
